TERMS AND CONDITIONS FOR EVENT TICKET PURCHASING:

1. General

1.1 These terms and conditions are an agreement between you and Simple Art by Yolandi Shaw (Pty) Ltd. Each ticket purchased from us is subject to our latest terms and conditions as well as any additional terms and rules applicable to the relevant event. The latest version of the terms and conditions are available on our website (www.simpleart.co.za). In these terms and conditions reference to one gender is a reference to all genders.

1.1.1 Without prejudice to any other rights or remedies in law, Simple Art by Yolandi Shaw (Pty) Ltd may cancel any one or more tickets forthwith if the purchaser breaches any of these terms and conditions and we may refuse to accept any further bookings from such purchaser.

If you breach any of our T’s and C’s, we might cancel your ticket and refuse to take further bookings from you.

1.2 Booking/ Purchasing procedure.

1.2.1 Tickets may be booked:

1.2.2 It is the purchaser’s duty to ensure that all booking information is correct and all payment information is correct. If booking information is incorrect, Simple Art by Yolandi Shaw (Pty) Ltd is not obliged to rectify any errors.

1.2.3 A booking request will constitute an offer to purchase a ticket on these terms and conditions. Such an offer is open for acceptance by Simple Art by Yolandi Shaw (Pty) Ltd (and/or the event organisers). It is your responsibility to review these terms and conditions as well as any additional terms and rules applicable to the relevant event before making a booking. Simple Art by Yolandi Shaw (Pty) Ltd reserves the right not to accept or process your booking request and we will notify you if this is the case.

We have the right not to process or accept your booking request – but we will notify you about this.

1.2.4 Following receipt of a booking request, Simple Art by Yolandi Shaw(Pty) Ltd will send a confirmation notice via email confirming acceptance or rejection of the booking request containing the relevant booking Please note that whilst every effort is made to send a confirmation notice for every valid booking request Simple Art by Yolandi Shaw(Pty) Ltd receives, we cannot guarantee that such confirmation notice will be received, nor that, if it is received, that it will be legible and uncorrupted. A failure to receive such confirmation notice will not affect the validity of the agreement concluded between us (or the event organisers) in respect of a booking.

If you do not receive a relevant booking email from us, it should still be fine, but maybe get in touch with us just to double check to email admin@simpleart.co.za. If you do not receive a confirmation notice – or if you receive an error message – after you have paid for your tickets, please let us know.

1.2.5 It is the purchaser’s duty to confirm with us whether or not a booking request has been received and processed if a confirmation notice is not received after submitting payment information, or if the purchaser experiences an error message or service interruption after submitting payment information. Simple Art by Yolandi Shaw (Pty) Ltd will not be liable for any losses a purchaser may incur if the purchaser assumes that a booking was or was not processed because of a failure to receive a confirmation notice.

1.2.6 The information submitted with a booking request will be processed as provided. If an error has been made or information needs to be changed, the purchaser should immediately contact us.

1.3 Pricing of tickets and information about events

1.3.1 The details of the events for which tickets are offered are contained on our website and other social media. The supply of tickets offered depends upon the availability thereof. Unless otherwise stated, all prices displayed are in South African Rand. Simple Art by Yolandi Shaw (Pty) Ltd may without prior notice change the price, cancel or postpone events, discontinue the availability of events or change the venues, seating arrangements and/or events for which tickets are made available. Special promotions may be subject to certain additional terms and conditions.

We may change anything (such as prices or seating). Also, any promotions might have additional T’s and C’s.

1.3.2 Although every effort is made to ensure that the venue and events are displayed and described completely and accurately, Simple Art by Yolandi Shaw (Pty) Ltd does not warrant same and disclaims, to the maximum extent permitted by law, any liability arising from any omissions and inaccuracies pertaining to such display and description. In particular, we disclaim any and all warranties as to the occurrence, suitability or quality of the seating arrangements, performances, venues or events and will not be liable for any claims arising in respect thereof, even if Simple Art by Yolandi Shaw (Pty) Ltd has acted in a negligent or grossly negligent manner.

1.4 Payment

1.4.1 You will be required to provide the necessary payment details (such as credit card details) and to authorise payment of the amounts payable for the tickets ordered when submitting your booking request. Such authorisation will allow Simple Art by Yolandi Shaw (Pty) Ltd to obtain payment at any time after confirmation of your booking.

1.4.2 If Simple Art by Yolandi Shaw (Pty) Ltd is unable to duly effect such payment for any reason your booking may be cancelled and your tickets may be resold to another customer without further notice.

1.5 Refunds, cancellations or exchanges

Any requests for refunds must be directed to admin@simpleart.co.za . All such requests will be considered on a case-by-case basis at Simple Art by Yolandi Shaw (Pty) Ltd.’s discretion. No refunds will be done for cancellations or missing of an event.

We deal with requests for refunds on a case-by-case basis. No refunds will be offered for negligence on your behalf.

1.7 Age and Event Restrictions

1.7.1 It is the purchaser’s responsibility to be aware of and to adhere to the type of restrictions that are applied to our events. Couples paint nights are for two adults in a relationship and not for children. Ladies paint Nights are for ladies only and allows no kids.

1.9 Cancelled and rescheduled events

Occasionally, events may be cancelled or rescheduled by Simple Art by Yolandi Shaw (Pty) Ltd and/or the event organiser. In such a case, please email admin@simpleart.co.za or the relevant event organiser to request a refund or exchange. All such requests will be considered on a case-by-case basis at Simple Art by Yolandi Shaw (Pty) Ltd (or the event organiser’s) discretion.

If a show is cancelled or rescheduled, we will refund you or exchange your tickets.

1.10 Right of admission

1.10.1 Simple Art by Yolandi Shaw (Pty) Ltd and/or the event organisers reserve all rights in terms of admission to cinemas or event venues.

We have a right to admit who we want to into our studio or other venues.

1.11 Security

1.11.1 Simple Art by Yolandi Shaw (Pty) Ltd will endeavour to ensure that necessary safety measures are in place to protect the sensitive payment information (such as your credit card details) which you provide to us.

We have safety measures in place when you make a payment.

1.11.2 Simple Art by Yolandi Shaw (Pty) Ltd, however, does not guarantee the absolute security of any information you transmit to us or that is transmitted to you and disclaims any liability arising in connection with any unauthorised disclosure of such information.

If your info is disclosed for some reason, we apologise, but cannot be held responsible for that.

1.12 Warranties

1.12.1 Unless the contrary is stipulated in writing, all tickets are provided without warranty of any kind. Without limiting the aforesaid, Simple Art by Yolandi Shaw (Pty) Ltd and the event organisers do not give any warranties or make any representations regarding the occurrence, timing, suitability, quality or performance of any film or event to which your ticket(s) may relate, or in respect of the venue, admission to such venue or the seating arrangements for such venue.

1.12.2 By purchasing a ticket from us, you agree to these terms and conditions on behalf of yourself and any person accompanying you. You assume all risks incidental to the event for which a ticket is issued, whether before, during or after the event. You agree that we will not be liable for any loss or damage you or anyone accompanying you may incur in the course of attending an event and that you will indemnify us against any claims arising in connection therewith.

We are not responsible for any loss or damage that may occur when you are attending an event.

1.12.3 If Simple Art by Yolandi Shaw (Pty) Ltd.’s aggregate liability for all claims from any attendee at any of our events is limited to the price paid for the relevant attendee(s) ticket(s), irrespective of the cause of action (whether in contract, statute or delict, including for gross negligence), save to the extent that such liability cannot be excluded by law.

1.13 These terms and conditions shall override any contrary terms or conditions incorporated by you in your order and any such conflicting terms or conditions will not form part of any agreement concluded between us in respect of the goods and/or services ordered.

2. Booking tickets

1.14 If any problems arise in respect of your ticket, please email admin@simpleart.co.za

2.1.1 Each ticket purchased from us is intended to be a revocable right to attend the event at the stipulated venue at the designated time to which the ticket pertains only and will not enable a holder to attend any other event.
